Chapter 3 - The Counter-Attack

The federal arrest of Daniel and Patricia Whitaker sent shockwaves through Briar County, but the battle was far from over.

Within twenty-four hours, Patricia’s brother, County Clerk Thomas Reed, used his extensive political influence and high-priced defense attorneys to secure temporary bail for both of them, pending a formal evidentiary hearing in federal court.

On Wednesday morning, I sat in the grand conference room of Vance & Associates Law Firm in downtown Richmond. Beside me sat my lead corporate attorney, Eleanor Vance, and Colonel Marcus Vance.

Across the long mahogany table sat Daniel, Patricia, and their lead defense counsel, a ruthless corporate litigator named Harrison Croft.

Daniel looked pale, his suit slightly disheveled, but Patricia sat upright, her chin held high, radiating venom.

"Let’s be reasonable, Major Vance," Croft began, sliding a leather folder across the table toward me. "My clients acknowledge that there may have been... administrative oversights... regarding the management of Vance Freight & Logistics over the past three years while you were deployed overseas."

"Administrative oversights?" Eleanor Vance scoffed. "You siphoned six million dollars of federal military transportation grants into private holding companies, Mr. Croft. That isn't an oversight. That is grand theft."

"My clients were keeping the company afloat while Major Vance was away!" Croft argued aggressively. "Furthermore, my clients hold a signed spousal proxy agreement executed by Daniel Whitaker on behalf of his wife during her medical coma at Landstuhl Regional Medical Center six months ago."

I felt a cold chill run down my spine. "A proxy signed while I was in an medically induced coma after an IED explosion?"

"It is legally binding under Virginia spousal emergency laws!" Patricia interjected, her voice dripping with spite. "You were brain-damaged, Rachel! You couldn't even speak! My son had to make executive decisions to save the business!"

"I was not brain-damaged, Patricia," I said, leaning forward across the table, my hands resting flat on the mahogany surface. "I had a severe concussion and physical trauma to my lower extremities. And my medical records from Landstuhl clearly state that I retained full legal competency."

I pulled a black tablet from my briefcase and opened an audio file.

"This is a recording from the hospital room in Germany," I said, pressing play.

Daniel’s voice came through the high-definition speaker, crystal clear: “Just sign the proxy line as her legal representative, Mom. She’s never going to walk again anyway. Once we get the logistics contracts transferred to our holdings, we can put her in a long-term care facility and take full control of the estate.”

Then Patricia’s voice: “Make sure the kid’s trust is liquidated too. We need the cash for the marina project.”

The silence in the conference room was absolute.

Daniel’s face turned an ashen grey. He looked at his lawyer, his hands trembling violently.

Croft slowly closed his notepad, leaning back in his chair, staring at his clients with utter disbelief. "Where did you get that recording?" Croft whispered.

"The Department of Defense records all communications in overseas military intensive care units for security purposes," Colonel Vance stated calmly from beside me. "The Federal Bureau of Investigation subpoenaed the audio logs yesterday morning."

Patricia slammed her hand on the table. "This is an illegal wiretap! This is a setup!"

"No, Patricia," I said, standing up slowly, using my hickory cane for balance, looking down at the two people who had destroyed my home, my peace, and my body. "This is accountability. You thought because I couldn't walk without pain, I couldn't fight. But you forgot one simple fact."

I leaned in close to Daniel, whose eyes were filled with pure terror.

"I spent ten years managing supply lines in combat zones. I know how to track every bullet, every dollar, and every coward."

"Rachel... please," Daniel whimpered, taking a step back. "We can work this out! I’m your husband! Think of Lily!"

"I am thinking of Lily," I said coldly. "Which is why by 1700 hours today, my legal team is filing for immediate emergency dissolution of marriage, sole legal and physical custody of our daughter, and full asset forfeiture of everything you purchased with my father’s money."

I turned on my heel and walked out of the conference room, the steady, rhythmic thump-clack of my cane echoing down the marble hallway like a drumbeat of war.
