Chapter 4 - The Financial Audit

By 3:00 PM that afternoon, the battle had shifted from the driveway of my Buckhead home to the sterile, mahogany-paneled chambers of Fulton County Superior Court.

Judge Harrison sat behind his massive wooden bench, his expression solemn and deeply uncomfortable. Sitting on the left side of the room was Marcus, flanked by his brother David and a team of four local corporate attorneys. On the right side sat me, flanked by Mr. Vance and three forensic financial accountants we had brought in from Manhattan.

Evelyn Montgomery sat in the gallery behind Marcus, her hands clutching her designer handbag so tightly her knuckles were white.

"We are here on an emergency motion regarding the temporary custody of Leo and Zuri Montgomery, as well as the freeze of joint marital assets," Judge Harrison announced, resting his elbows on the bench. "Mr. David Montgomery, your team filed an emergency ex parte order claiming the mother was an immediate flight risk and financially unstable. Care to explain why I shouldn't sanction your firm for failing to disclose the mother's verified liquid assets?"

David stood up, adjusting his coat nervously. "Your Honor... my client, Marcus Montgomery, was completely unaware of the extent of the private funds held by the late Elias Vance. We believed the mother was engaging in reckless financial maneuvers that put the children's lifestyle at risk. Furthermore, my client is the primary breadwinner of this family. He earns over $1.2 million annually as Senior Managing Director at Aegis Financial Group. He provides the lifestyle these children have known their entire lives!"

"Primary breadwinner?" Mr. Vance interrupted softly, standing up from our table.

"Mr. Vance, you have the floor," Judge Harrison said.

Mr. Vance signaled to one of our forensic accountants, who handed a thick blue binder to the judge and a duplicate to Marcus’s legal team.

"Your Honor," Mr. Vance began, his voice echoing with absolute authority. "For seven years, Marcus Montgomery painted his wife as a dependent burden. He used psychological financial control to keep her isolated. But over the last seventy-two hours, our forensic accounting team audited every transaction across the joint and private accounts linked to Vanguard Holdings and Aegis Financial Group."

Marcus leaned forward, whispering frantically to his lead attorney.

"What did you find, Mr. Vance?" Judge Harrison asked, turning the pages of the binder.

"We found that Mr. Marcus Montgomery has been engaging in systematic financial fraud," Mr. Vance declared calmly.

Evelyn gasped from the gallery. "That's libel!" she shouted.

"Order in the court!" Judge Harrison slammed his gavel. "One more outburst from the gallery and I will have you removed!"

Mr. Vance continued without breaking stride. "Over the past four years, Mr. Montgomery transferred over $1.8 million from joint family accounts into offshore accounts in the Cayman Islands under the name Elysium Ltd. Our investigations confirm that Elysium Ltd. is a shell company controlled entirely by his sister-in-law, Mrs. Sarah Montgomery."

The courtroom went dead silent.

Marcus turned his head sharply to look at Sarah, who was sitting in the second row of the gallery. Sarah’s face drained of all color.

"Furthermore," Mr. Vance added, dropping another hammer, "Mr. Montgomery used these diverted family funds to purchase luxury assets—including a $400,000 beachfront condominium in Miami—which were registered under Sarah Montgomery's personal name. While my client, Saraphina, was given a strict monthly allowance of $1,500 for groceries and child supplies, Mr. Montgomery was funding his sister-in-law's lavish lifestyle behind his wife's back."

David stared at his brother Marcus, his jaw dropping. "What?! Marcus, what is he talking about?!"

"David, wait! It's not what it looks like!" Marcus stammered, sweating profusely. "It was... it was real estate investments!"

"Real estate investments?" I spoke up, standing next to my attorney and looking directly at Marcus. "Is that what you called it, Marcus? When you spent forty thousand dollars on a Cartier diamond bracelet last December that never made it into my hands? I found the receipt in your golf bag three months ago. I thought it was for your mother."

David turned slowly to face his wife, Sarah. "Sarah... did he buy you a Cartier bracelet?"

Sarah shrank back in her seat, unable to meet her husband's eyes.

"Your Honor," Mr. Vance said, addressing the bench. "We have submitted formal criminal referrals to the Internal Revenue Service and the Federal Bureau of Investigation regarding wire fraud and tax evasion committed by Mr. Marcus Montgomery and Mrs. Sarah Montgomery. Given this severe financial criminality and stability risk, we request that full temporary physical and legal custody of the children remain exclusively with Mrs. Saraphina Montgomery, and that Mr. Montgomery be barred from coming within 500 feet of her or the kids."

Judge Harrison closed the blue binder with a heavy thud. He looked down at Marcus with utter disgust.

"Motion for emergency custody by the father is DENIED," Judge Harrison ruled coldly. "Full temporary physical and legal custody is awarded to the mother, Saraphina Montgomery. Mr. Marcus Montgomery, you are ordered to vacate any joint claims immediately. Your personal accounts are hereby FROZEN pending a complete federal audit."

Marcus slumped back in his chair, his eyes hollow. His mother covered her face with her hands, sobbing in humiliation.

I looked at my ex-husband, my voice steady and cold. "You called me a leech, Marcus. But it turns out, you were the one bleeding my family dry. And now, you're going to pay back every single cent."
