Chapter 4 - The Injunction

By 2:00 AM, while the rest of the hospital was asleep, Victoria Vance had set up an emergency command post inside my private recovery room.
Paperwork was scattered across the overbed table—admissions records, surgical logs, and printed affidavits. Victoria was on her laptop, her fingers flying across the keyboard with methodical precision, while Dr. Emily Carter sat in a chair beside me, completing a signed medical declaration.
"This is the key," Dr. Carter said, signing her name at the bottom of a legal document with a heavy blue pen. "I have officially documented that Margaret Bennett produced a fraudulent power of attorney during an active surgical emergency and attempted to compel a physician to perform a non-consensual tubal ligation on an incapacitated patient."
Victoria reviewed the document, nodding approvingly. "This isn't just a custody battle anymore. This is criminal fraud, medical coercion, and intentional infliction of emotional distress. We are filing an emergency ex-parte petition with the duty judge at the Family Court at 7:00 AM."
"What does an ex-parte petition do?" I asked, sipping warm broth to regain my strength.
"It means we appear before a judge without notifying Margaret or Daniel," Victoria explained, her sharp eyes gleaming in the dim light of the room. "We are requesting three immediate emergency orders: First, an emergency Temporary Restraining Order against Margaret and Daniel Bennett, barring them from coming within 500 feet of you or Noah. Second, an order granting you temporary sole legal and physical custody of Noah. And third, an immediate court injunction blocking any medical transfer of Noah out of St. Matthew’s Medical Center."
"Will a judge grant that before 9:00 AM?" I asked fearfully. "Margaret said her lawyer is meeting the Chief of Surgery at nine."
"Judge Sarah Jenkins is the presiding duty judge this week," Victoria smiled—a cold, ruthless expression. "She happens to be a fierce advocate for women's rights and hates corporate bullies who try to use their money to subvert the court. When she reads Dr. Carter’s affidavit detailing an attempted forced sterilization, she will sign that injunction so fast Margaret’s lawyer won't know what hit him."
At 7:30 AM, Victoria departed for the county courthouse.
I spent the next hour sitting in my bed, counting every second as the clock on the wall ticked loudly. 8:00 AM. 8:15 AM. 8:30 AM.
At 8:45 AM, the door to my room flew open.
Margaret Bennett marched in, followed by Daniel and an older man in a expensive pinstripe suit carrying a leather folder—Arthur Pendelton, the Bennett family attorney. Behind them were two private transport paramedics holding a portable medical transport pod.
"Get her ready," Margaret ordered the paramedics, pointing toward the door. "We are moving the baby now."
"Margaret, you can't be in here," Dr. Carter said, stepping in front of my bed, her arms crossed over her chest. "Rachel is my patient, and this is a restricted recovery floor."
"Move out of the way, Doctor," Arthur Pendelton said smoothly, stepping forward and handing Dr. Carter a packet of papers. "This is a legal authorization for patient transfer signed by Daniel Bennett, the biological father and legal natural guardian of Noah Bennett. The Chief of Surgery has already been notified. We are legally removing the child from this facility."
I sat up straight in my bed, ignoring the tearing pain in my abdomen, and stared directly at Daniel. "You are really going to do this, Daniel? You're going to let your mother kidnap our son?"
Daniel couldn't meet my eyes. He looked staring at the wall behind my head. "It's for his health, Rachel. Boston has better doctors."
"He doesn't need better doctors! He's stable right here!" I yelled. "You're doing this because you're terrified of your mother!"
"Enough of this nonsense," Margaret snapped, turning to the paramedics. "Go to the NICU and secure the baby."
"Nobody is touching that baby!" a loud, booming voice echoed from the hallway.
Victoria Vance walked into the room, wearing her sleek trench coat, holding a red-stamped court document high in her hand. Right behind her were two uniformed County Sheriff's Deputies.
Margaret’s attorney frowned, his eyes narrowing. "Who are you?"
"I am Victoria Vance, legal counsel for Rachel Bennett," Victoria announced, stepping directly between Margaret and the door. She slapped the stamped document hard against Arthur Pendelton’s chest. "And this is an Emergency Ex-Parte Order issued by Judge Sarah Jenkins of the First Circuit Family Court fifteen minutes ago."
Pendelton quickly scanned the document, his face draining of color instantly. "This... this is an ex-parte injunction?"
"It is an immediate Temporary Restraining Order," Victoria declared, her voice ringing clearly down the hospital corridor. "Rachel Bennett is granted exclusive temporary sole legal and physical custody of Noah Bennett. Daniel Bennett and Margaret Bennett are hereby barred from coming within 500 feet of Rachel or the infant. Furthermore, any attempt to transfer, move, or alter Noah Bennett’s medical care constitutes an immediate class-three felony offense."
Margaret’s face turned bright, blotchy red with fury. "This is absurd! My son is the father! He has rights!"
Victoria stepped directly into Margaret’s face, standing inches away from the older woman. "Your son surrendered his moral authority when he stood in an operating room and agreed to have his wife illegally sterilized. And you, Mrs. Bennett, are currently under investigation by the District Attorney’s office for document forgery and medical coercion."
Victoria turned to the two Sheriff's deputies. "Officers, please escort these individuals off the hospital premises immediately. If they refuse to leave, arrest them for criminal trespass and violation of a protection order."
The head deputy stepped forward, resting his hand on his belt holster. "Mr. and Mrs. Bennett, sir, ma'am... you need to turn around and walk out of this building right now."
Margaret stood frozen, her mouth open in absolute shock and humiliation. She looked at Victoria, then at Dr. Carter, and finally at me.
I looked back at her from my hospital bed, my chin held high, my eyes burning with unwavering triumph.
"Get out of my hospital," I said quietly.
Arthur Pendelton grabbed Margaret’s arm, pulling her back. "Margaret, we need to leave. Now. We will handle this in court."
Margaret pulled her coat tight, her eyes glaring at me with pure, unadulterated hatred. "You think you've won, Rachel? You don't have a dime. I will drain you dry in court until you are bankrupt, homeless, and begging me to take that child off your hands!"
"Try it, Margaret," Victoria replied coolly. "I love a good fight."

As the deputies escorted Margaret, Daniel, and their attorney down the hallway, Daniel turned his head back one last time, looking at me through the glass door.
I turned my head away, refusing to give him even a single glance, and looked out the window as the morning sun finally broke through the clouds.
