Chapter 5 - The Insolvency Hearing

Three weeks later, Courtroom 402 of the United States Bankruptcy Court was packed to capacity.
The air inside smelled of old paper, leather briefcases, and tense anticipation. Sitting at the defense table were Richard, Mason, and Vanessa Cole, all wearing orange institutional jumpsuits, flanked by four court-appointed public defenders. Their private legal team had resigned ten days prior after three million dollars in retainer fees were frozen as proceeds of criminal fraud.
Sitting at the petitioner’s table, I wore a crisp navy suit, with Sarah Sterling by my side.
Judge William Henderson, a formidable man with thick white hair and heavy eyebrows, looked down from the bench over his reading glasses, reviewing the five-hundred-page bankruptcy restructuring motion submitted by Apex FinTech.
"Mr. Cole," Judge Henderson said, his deep voice echoing off the wood-paneled walls, addressing Richard. "Your counsel has submitted an emergency petition requesting a stay of liquidation, claiming that your firm's sudden insolvency was artificially induced by the petitioner, Daniel Bennett."
Richard stood up slowly, the metal chains around his ankles clinking against the hardwood floor.
"Your Honor," Richard rasped, his voice hollow and broken. "Daniel Bennett acted out of personal malice. He orchestrated a hostile takeover of my company’s infrastructure on the very day he was supposed to join my family! He used trade secrets he gained while acting as my personal financial consultant to destroy my life’s work!"
Judge Henderson looked at me. "Mr. Bennett, how do you respond?"
I stood up calmly, adjusting my button jacket.
"Your Honor," I said clearly, my voice ringing with total authority. "I did not induce insolvency. I merely revoked unauthorized access to Apex FinTech’s proprietary clearing algorithms. Cole Global Logistics was operating at an active monthly deficit of four point two million dollars for over two years. Richard Cole kept the firm afloat by forging my authorization code to pledge non-existent treasury bonds as collateral for private bank loans."
Sarah Sterling immediately handed a thick stack of certified bank receipts to the bailiff, who brought them directly to the judge’s desk.
"Furthermore, Your Honor," I continued, "the liquidation plan submitted by Apex does not destroy Cole Logistics. It protects it. We have offered to buy back one hundred percent of the firm’s physical assets, clear all back-wages for the twelve hundred employees, and assume full operational control under a transparent trust."
Judge Henderson spent three minutes reviewing the documents. The silence in the courtroom was absolute.
Finally, the judge set his pen down with a loud thud.
"The court finds that the debtor, Cole Global Logistics, has engaged in systemic, long-term financial fraud," Judge Henderson ruled firmly. "The motion for a stay of liquidation is DENIED. The court hereby approves the complete asset acquisition by Apex FinTech Solutions, effective immediately."
Vanessa let out a low, pathetic sob, dropping her face onto the cold wooden table.
Richard fell back into his chair, staring at the ceiling as if his entire world had collapsed on top of him.

Mason glared at me with pure, unadulterated hatred. "You took everything from us, you bastard!" he yelled, jumping up before two bailiffs shoved him back down into his seat.
I picked up my briefcase, turned my back on the Cole family, and walked out of the courtroom into the bright afternoon sun.
