Chapter 5 - Legal Warfare & Custody Battles

Two weeks later, the civil court hearing for emergency custody opened in the Baltimore City Circuit Court.
Tyler, wearing a cheap, off-the-rack suit purchased by his court-appointed public defender after his private legal council withdrew due to unpaid retainers, sat at the defense table. He looked haggard, having lost fifteen pounds over two weeks. His eyes were bloodshot, and his arrogance was entirely gone, replaced by a desperate, twitchy energy.
On the other side of the courtroom sat Clara. She looked radiant, powerful, and utterly composed. She wore a tailored white dress jacket, her dark hair pinned neatly back. beside her sat Arthur Pendelton and a team of top-tier family law attorneys.
Judge Evelyn Vance (no relation to Tyler) presided over the courtroom with a sharp, no-nonsense demeanor.
"Mr. Vance," Judge Vance said, eyeing Tyler over her reading glasses. "Your council has filed a petition requesting joint physical and legal custody of the three infants, as well as an order compelling Mrs. Hartwell to unfreeze joint family accounts to cover your legal expenses. Is that correct?"
"Yes, Your Honor," Tyler’s public defender stood up, clearing his throat nervously. "My client is the biological father of these children. While there are ongoing corporate disputes between Mr. and Mrs. Vance, Mr. Vance has a fundamental constitutional right to parent his children. Mrs. Vance’s actions in transferring the infants without his knowledge were extreme and designed to alienate the father from his newborn infants."
Judge Vance looked over at Clara’s legal team. "Mrs. Hartwell’s counsel, your response?"
Arthur Pendelton stood up smoothly. "Your Honor, we have submitted into evidence the verified emergency medical logs from St. Matthew’s Hospital from the night of August 14th, along with sworn affidavits from the attending obstetrician and chief neonatal specialist."
Arthur walked toward the bench, handing a thick document binder to the bailiff.
"While Mrs. Hartwell was suffering a massive internal hemorrhage during an emergency C-section at thirty-two weeks gestation, Mr. Vance was repeatedly contacted by medical staff regarding the critical condition of both his wife and his three infants," Arthur stated. "Mr. Vance consciously turned off his mobile device to avoid interruption during a social gathering in Virginia."
Arthur pressed a button on a remote control. The courtroom screens flickered to life, showing the public video Cassandra Vale had posted on social media. Tyler’s image appeared—grinning, holding a glass of champagne, raising a toast while the timestamp in the bottom corner clearly read: AUG 15 - 02:14 AM.
"At the exact moment this video was recorded," Arthur continued, his voice echoing with somber power, "infant Ava Vance had ceased breathing and was being resuscitated by a neonatal team. Infant Miles Vance was suffering from acute respiratory failure. And Mrs. Hartwell was receiving four units of emergency blood transfusion."
The judge stared at the video screen, her face hardening into a mask of pure indignation.
"Furthermore," Arthur added, "we have submitted financial records proving Mr. Vance misappropriated over four million dollars from the company founded by Mrs. Hartwell’s mother, using those funds to support a lavish extramarital affair. Mr. Vance poses an extreme flight risk, lacks financial stability, and has demonstrated a complete and total abandonment of parental duty during a critical life-or-death crisis."
"That's not true!" Tyler blurted out, standing up from his chair. "I love my children! I was going to come back! Clara is just doing this out of revenge! She’s trying to ruin me!"
"Sit down, Mr. Vance!" Judge Vance snapped, slamming her gavel down with a sharp crack that echoed off the high mahogany walls. "One more outburst from you and I will hold you in contempt of court immediately!"
Tyler collapsed back into his chair, breathing heavily, his public defender whispering frantically for him to keep quiet.
Judge Vance reviewed the documents before her, her eyes scanning the medical logs, the forensic financial reports, and the social media evidence. After three long minutes of absolute silence, she looked up, her gaze pinning Tyler to his seat.
"Under Maryland Family Law Code," Judge Vance declared, her voice firm and absolute, "the paramount consideration of this court is the physical safety and best interests of the children. Mr. Vance’s actions on the night of August 14th constitute severe, willful neglect and endangerment of both his former spouse and three fragile neonates."
She signed the order on her desk with a decisive flourish of her pen.

"The court hereby grants Mrs. Clara Hartwell sole legal and physical custody of Ava, Noah, and Miles Vance. Mr. Vance is denied visitation rights until such time as his pending criminal matters are fully resolved, and until he completes a court-mandated mental health and parenting evaluation. Furthermore, the court finds no grounds to unfreeze corporate or trust assets for Mr. Vance's personal legal defense."
Judge Vance looked directly at Tyler, her eyes cold. "You made your choices, Mr. Vance. Now you will live with the consequences."
