Chapter 5 - The Legal Fortress

The modern high-rise that housed the State Attorney’s Office looked out over the gray, ice-flecked expanse of the river. By 10:00 a.m., the main conference room on the sixteenth floor had turned into a command center for the prosecution team.

Detective Ruiz sat at the head of the table, surrounded by three senior assistant district attorneys and Marcus Vale, who had successfully integrated the Sterling Enterprises database into our tracking system.

"We have a problem with the bail hearing," Ruiz said, dropping a legal brief onto the table. "Daniel’s criminal defense team just filed an emergency motion for a private surety bond. They’ve found a secondary investment firm based out of Delaware—Delphi Holdings—that’s willing to post the five-million-dollar cash bail for him."

I leaned forward, my fingers tapping against the polished wood of the table. "Delphi Holdings isn't a real firm, Mara. Who’s the primary beneficiary behind the shell?"

Marcus pulled up a corporate registry map on the large monitor wall. "Look at the secondary routing, Elena. Delphi Holdings is funded entirely by a series of discretionary trusts registered under the name of Thomas Mercer—Daniel’s older brother who lives in Switzerland."

"Thomas?" I murmured, the memory of Daniel’s quiet, reclusive brother coming back to me. "Thomas hasn't spoken to Daniel in four years. Why would he risk five million dollars to bail him out of an attempted murder charge?"

"He isn't doing it for Daniel," Marcus said, shifting the screen to display a series of international patent filings. "Thomas holds thirty percent of the secondary development rights for your father’s logistics software. If Daniel goes to prison and the software defaults back to your father’s estate, Thomas loses his European distribution rights. He’s trying to buy Daniel enough time outside of a cell to execute a secondary assignment of the code to a Swiss corporation before the state court can freeze the asset."

"They’re trying to steal the property right out from under the court's nose," one of the assistant district attorneys said, shaking his head. "If Daniel signs that transfer while out on bail, the intellectual property leaves US jurisdiction. It will take us years to extradite the code from the Swiss courts."

"Then we don't let him out," I said, my voice flat and cold.

"Elena, the state guidelines for attempted murder allow for bail if the defendant has no prior violent criminal history," the attorney explained. "His lawyers will argue he’s a non-violent corporate executive who poses no flight risk if his passport is surrendered."

"He is a flight risk," I said, standing up and walking over to the monitor wall. "Marcus, look at Daniel’s personal credit log from the last forty-eight hours before the wedding. Did he purchase any international travel?"

Marcus scanned the lines of data, his fingers dancing across the keys. "Nothing under his name. No flights, no trains, no charter bookings."

"Check the name Liam Mercer," I ordered. "That was the name of our son—the baby we lost during my second year of marriage. Daniel kept a secondary social security card and a birth registration file in the house vault for tax purposes."

The room went completely silent as Marcus entered the parameters. Five seconds later, a red line flared on the screen.

"My God," Marcus whispered. "A private charter flight out of Midway Airport, scheduled for 11:30 p.m. tonight. Destination: Zurich, Switzerland. The passenger name listed on the manifest is Liam Mercer, with a secondary passport number that was issued through the Dublin embassy three weeks ago using a forged birth certificate."

Detective Ruiz stood up so quickly her chair hit the wall behind her. "He wasn't planning on staying for the honeymoon with Vanessa. He was going to leave her at the reception and disappear with the software code tonight."

"Take this to the presiding judge immediately, Mara," I said, turning to look out the window at the freezing rain. "We don't just ask for a high bail. We ask for an absolute hold without bond under the federal flight risk guidelines. Daniel Mercer isn't a corporate executive trying to sort out his life. He’s a international fugitive who has already tried to kill his family twice."
