Chapter 7 - THE CUSTODY TRIAL

The Manhattan Family Court building stood like a cold, imposing fortress of gray granite amidst the damp morning fog.
By 8:30 AM, the courtyard outside was completely swarmed by hundreds of reporters, news vans with satellite dishes, and curious onlookers. The news of the late-night home invasion at the Morgan estate had leaked to the press, turning an already explosive child custody trial into the trial of the century.
A fleet of three black armored SUVs pulled up to the court curb.
Frank and four private security officers stepped out first, forming a tight perimeter. Then Robert stepped out, looking regal and imposing in a dark navy tailored suit. He reached back into the car and lifted Sophia out in his arms.
The little girl was dressed in a neat, navy-blue wool coat with a white lace collar. She buried her face into Robert’s shoulder, terrified by the blinding flashes of a hundred cameras and the roar of shouting reporters.
"Mr. Morgan! Did Arthur Pendelton send those men last night?!"
"Sophia! Do you want to live with your uncle?!"
"Robert! Are you confident about the DNA results?!"
"Keep moving," Frank grunted, clearing a path through the roaring crowd as Robert carried Sophia swiftly up the grand stone steps and into the secure lobby of the courthouse.
Ten minutes later, they were inside Courtroom 402.
The courtroom was vast, panelled in dark walnut wood. At the front table on the left sat Michael Vance, looking drastically different from the filthy, angry man Robert had confronted in Harlem two nights ago. Vance was dressed in an expensive, ill-fitting gray suit, his hair neatly combed back, though his bloodshot eyes and nervous twitches betrayed his ongoing addiction withdrawals. Sitting beside him was his lead attorney, Richard Sterling—a notoriously aggressive trial lawyer hired by Pendelton’s defense fund.
At the spectator gallery in the back, Arthur Pendelton himself sat quietly in a dark corner, flanked by two corporate defense lawyers. He looked pale, haggard, and dark-eyed, aware that state police warrants were currently being drawn up against his shell companies.
At 9:00 AM sharp, the side door opened, and Judge Patricia Vance (no relation to Michael Vance)—a sharp, middle-aged woman with a reputation for stern, no-nonsense rulings—sat behind the high bench.
"Court is in session," Judge Vance declared, striking her gavel once. The courtroom fell dead silent. "We are here for Case #F-8841: Emergency Protective Order and Custody Determination regarding the minor child, Sophia Vance. I will hear opening arguments from the petitioner’s counsel first."
Richard Sterling stood up smoothly, adjusting his buttoned suit jacket.
"Thank you, Your Honor," Sterling began, his voice booming with practiced courtroom theatricality. "This is a simple, tragic case of a wealthy, grieving billionaire who believes his immense fortune places him above the law. Two days ago, Mr. Robert Morgan lost his daughter. In his deep grief, he encountered my client, Mr. Michael Vance, and his lawful ward, Sophia, on Fifth Avenue."
Sterling gestured dramatically toward Michael Vance.
"Mr. Vance is the legal uncle and court-appointed guardian of Sophia following the tragic death of her mother, Sarah Vance, six weeks ago," Sterling argued, turning a cold glare toward Robert. "Mr. Morgan used physical force and corporate intimidation to break into my client's home, assault him, and kidnap this frightened six-year-old child. Mr. Morgan claims he did this out of charity. We claim it is a clear felony kidnapping disguised as philanthropy. We demand the immediate return of Sophia to her lawful guardian, Mr. Vance, and the immediate arrest of Robert Morgan."
A murmur went through the gallery.
Judge Vance noted Sterling’s points calmly, then looked toward Robert’s table. "Counsel for the respondent?"
Eleanor Vance stood up gracefully, her posture radiating quiet, unshakeable confidence.
"Your Honor," Eleanor began, her voice calm, clear, and ringing with absolute truth. "Opposing counsel paints a picture of a peaceful family disrupted by a wealthy mogul. Allow me to present the reality that Mr. Sterling conveniently left out."
Eleanor opened her leather folder and handed a stack of certified documents to the bailiff, who passed them up to the judge.
"First," Eleanor stated, "we submit certified high-resolution medical photographs taken thirty-six hours ago by an independent pediatric physician. They show extensive, severe physical abuse on the minor child's body—including deep tissue contusions along her forearms and face, consistent with habitual physical violence inflicted by Michael Vance."
Michael Vance shifted uncomfortably in his chair, sweating under the judge's sudden, sharp glare.
"Second," Eleanor continued, raising her voice slightly, "we submit the certified criminal records of Michael Vance, showing three prior convictions for domestic battery and grand larceny, alongside evidence that he was forcing this six-year-old child to beg for money on Fifth Avenue to fund his illegal substance addictions."
"Objection!" Sterling shouted, leaping to his feet. "My client’s past has no bearing on the legality of his guardianship!"
"Overruled, Mr. Sterling," Judge Vance said coldly, reviewing the horrific bruise photographs on her monitor. "The physical condition of the child is paramount to this court."
"Furthermore, Your Honor," Eleanor pressed on, turning the final page of her filing, "we present to this court a certified Genomic Analysis Report from the Manhattan Genomics Institute. It proves with 99.99% statistical certainty that the minor child, Sophia, is the biological daughter of the late Marina Morgan, and the biological granddaughter of Robert Morgan."
The courtroom erupted into loud gasps. Judge Vance looked up from her screen, her eyes wide with deep astonishment.
"Biological granddaughter?" Judge Vance repeated, looking between Robert and the small child sitting beside him. "How is that biologically possible, Ms. Vance?"
"Because six years ago, Your Honor," Eleanor declared, pointing a finger directly toward Arthur Pendelton in the spectator gallery, "a criminal conspiracy was executed. Marina Morgan’s cryopreserved genetic tissue was stolen from Mount Sinai Hospital, and an illegal surrogacy was conducted at the St. Jude Reproductive Health Institute—funded secretly by Mr. Arthur Pendelton through a shell company!"
Arthur Pendelton bolted out of his seat in the gallery. "She’s lying! This is a corporate hit job!"
"Order! Sit down, sir, or I will have you removed and held in contempt!" Judge Vance slammed her gavel repeatedly, her voice echoing like a trumpet.
Once order was restored, Eleanor called her surprise witness: "The defense calls Dr. Victor Mercer to the stand."
Dr. Mercer stepped into the courtroom through a side door, escorted by two uniformed court officers. He took the witness stand, trembling, and under oath, confessed to the entire operation—detailing Pendelton’s bribes, the stolen tissue, Sarah Vance’s surrogacy, and the secret creation of Sophia to be used as a corporate pawn.
As Mercer spoke, Michael Vance began to panic, looking frantically toward Sterling and Pendelton.
"He promised me fifty thousand dollars!" Michael Vance suddenly blurted out, breaking down under the pressure and shouting at the judge. "Mike Pendelton’s lawyers gave me cash to keep the kid on the street! They told me to file the kidnapping charges! I didn't steal no baby! Sarah brought her home!"
"Quiet, you fool!" Sterling hissed, trying to pull his client back down into his chair.
Judge Vance slammed her gavel three times, her face set in absolute, icy fury.
"That will be enough!" Judge Vance declared, her voice booming through the walnut-panelled room. "I have heard more than enough."
She looked down from the bench at Michael Vance, then at Arthur Pendelton, and finally at Robert Morgan, who was holding Sophia’s hand under the table.
"This court finds that Michael Vance has engaged in severe, persistent child abuse, neglect, and participation in an illegal scheme," Judge Vance ruled, her words sharp as a guillotine. "His legal guardianship over Sophia Vance is hereby PERMANENTLY TERMINATED with prejudice. I am ordering the bailiff to take Mr. Vance into immediate custody pending formal child endangerment charges."
Two court officers instantly stepped forward, slapping handcuffs on Michael Vance's wrists as he screamed and cursed, dragging him out of the courtroom.
Judge Vance then turned her gaze to Robert Morgan. Her expression softened, replaced by deep respect and profound warmth.
"Regarding the biological grandfather, Robert Morgan," Judge Vance continued, "the evidence of biological kinship is undeniable, and his immediate action to protect this child from severe physical harm was not only lawful, but heroic. Therefore, this court grants IMMEDIATE AND FULL LEGAL AND PHYSICAL CUSTODY of Sophia to Robert Morgan."
Tears welled up in Robert’s eyes. He closed his eyes, bowing his head as a massive wave of relief washed over his entire body.

"Yes, my sweet girl," Robert choked out, gathering her into a tight, tearful embrace as the courtroom erupted into cheers and applause. "You're coming home. For good."
