Chapter 23 - The Legal Siege Begins
By 8:00 AM the following morning, the wedding decorations in the backyard were being soaked by a sudden, heavy downpour of rain—as if the sky itself was mirroring the turmoil inside the house.
Emily, Julian, and Aunt Marlene sat around the large oak dining table, surrounded by stacks of old family archives. Ana Brennan, their trusted estate attorney, arrived drenched from the rain, her briefcase bulging with legal textbooks.
"I ran a preliminary search on Victoria Darcy the moment Julian called me last night," Ana said, skipping all pleasantries as she opened her laptop. "Marlene is right to be worried. Victoria has spent the last fifteen years in Switzerland working as a high-level asset recovery specialist. She specializes in exploiting ancient loopholes in family trusts."
"Can she really take the house because I changed my name to Julian's?" Emily asked, her hands tightly gripping a mug of hot coffee.
Ana sighed, rubbing her temples. "The 1994 Irrevocable Trust she referenced is a real legal entity. I managed to find a digital record of its existence in the county archives early this morning. In the 1990s, the Darcy family estate was facing massive lawsuits from a failed shipping venture. To protect the land, Abigail put the property into a strict bloodline trust. It contains a 'Name and Arms' clause—an old legal relic that requires the primary beneficiary to maintain the Darcy surname."
Julian frowned deeply. "But that’s an archaic rule. Surely modern courts don't enforce things like that?"
"Ordinarily, no," Ana explained. "But because it’s an irrevocable trust, the terms are set in stone unless every living beneficiary agrees to change them. Victoria never agreed because she was missing. Now that she’s back, she’s claiming that the moment Emily signed the marriage certificate yesterday and legally changed her name to Emily Vance, she violated the trust conditions. The property would automatically revert to the next eligible living Darcy by birth. Which is Victoria."
"This is sickening," Julian said, his fist clenching against the table. "We spent months paying off the liens Mark left behind. We repaired the roof, we restored the grounds. Where was Victoria when the house was falling apart?"
"She was waiting," Emily realized, a cold wave of clarity hitting her. "She waited for us to do all the hard work. She waited for the debts to be cleared and the property value to skyrocket. She waited until the exact moment I was most vulnerable—my wedding day—to strike."
"So, what's our move, Ana?" Julian asked.

"We file an emergency injunction to halt any eviction or property transfer," Ana said resolutely. "But we need to find a loophole within their loophole. I need to dig into the exact definition of 'maintenance' in that 1994 document. If Victoria abandoned her financial duties to the trust for twenty years, we might be able to argue laches—that she waived her rights through sheer neglect."
"Do it," Emily said, looking out the window at the rain-soaked roses. "I didn't save this house from my father just to hand the keys over to an aunt I’ve never met."
